The arrest is only the beginning. There are several “not so nice things” you need to be aware of when you are charged with DWI.

Possible Jail Time
The least serious DWI charge is a Class B Misdemeanor with a maximum fine of $2000.00 and 6 months in jail.

Two Possible Drivers License Suspensions Arising From the Same DWI

License Suspension Upon Conviction
If you are convicted of a first time DWI your license will be suspended for one year.

License Suspension ALR (Administrative License Revocation) This type of suspension is separate from the suspension you receive upon conviction.

If you blow a .08 or more the Department of Public Safety will try to suspend your license for 90 days unless you timely request a hearing to contest it. To be timely, the hearing must be requested within 15 days from the time your served notice (usually the day of arrest). If the hearing is not requested timely, your license will be automatically suspended 40 days from the date of arrest.

If you refuse to blow the Department of Public Safety will try to suspend your license for 180 days. Again, you must timely request a hearing to contest it. If the hearing is not requested timely, your license will be automatically suspended 40 days from the date of arrest.

Contact us as soon as possible after the arrest so that we can request the hearing on the ALR. If we represent you on the DWI, we will also represent you in the ALR hearing.

Occupational License
Should you lose your license, either as the result of a conviction or through the ALR proceeding, we can usually file for an occupational license by showing an essential need such as work, school, etc. Do be aware however that the occupational license carries with it restrictions as to time and places you may drive. Driving outside of the restrictions is considered driving on a suspended license which is a Class B Misdemeanor.
